A freezing order is an interim injunction which restrains a defendant or potential defendant from disposing of or dissipating assets, typically by a claimant or potential claimant who wishes to ensure that assets remain available pending the enforcement of a court judgment.
Different types of assets can be frozen, including bank accounts, shares, investments, land and property. They can include all assets that a defendant has a legal or beneficial interest in.
A freezing order can be served against an individual or company for a number of different reasons, but ordinarily a freezing order will be granted where the Court is convinced there is a good arguable case and there is a risk that a Defendant will remove assets beyond the reach of the claimant.
The use of a freezing injunction should not be oppressive and should allow the defendant to continue trading. An individual should also be able to meet living expenses and afford reasonable legal costs.
