Robbery (inc. Armed Robbery)

The offence of robbery involves taking or attempting to take anything of value by force, threat of force or by putting the victim in fear. At common law, robbery is defined as taking the property of another, with the intent to permanently deprive the person of that property, by means of force or fear.

Robbery is prosecuted under section 8(1) of the Theft Act 1968 and is an indictable only offence. This means the offence can only be heard in the Crown Court (unless the defendant is a minor in which case it will be heard in the Youth Court). 

Penalties for robbery are severe, with the maximum sentence being life imprisonment. Many factors will be taken into consideration, such as the extent of force employed; whether weapons were used; whether a vulnerable person was involved; whether disguises were worn; and the value of the items stolen. Other factors can be argued by the defence to lessen the penalties, such as if the robbery was an opportunistic act, or if the defendant had only a small part to play in the robbery.
